These Terms of Service ("Terms") govern your access to and use of LevelUpSpot.org, the Level Up Spot™ mobile applications, and all related services (collectively, the "Services") operated by Level Up Spot, LLC ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
The Level Up Spot™ name, trademark, platform, system, and related intellectual property are licensed to Level Up Spot, LLC by PeerNextGroup, Inc., which retains ownership of such intellectual property. Level Up Spot, LLC operates the Services and is solely responsible for user interactions, service delivery, and data handling. Nothing in these Terms grants you any ownership rights in the Level Up Spot™ intellectual property.
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
Level Up Spot™ is a peer support platform that provides access to peer-led support conversations, practical next-step planning, community-based engagement, and optional navigation assistance to external resources. The Services may be delivered digitally or through in-person pop-up locations designed as community safe spaces.
Peer specialists are individuals with lived experience who are trained to provide non-clinical support. The Company is a technology-enabled platform and community access point. It does not provide healthcare, medical treatment, psychiatric services, therapy, counseling, case management, or legal services.
The Services do not provide medical, psychiatric, psychological, therapeutic, or legal advice. Peer specialists are not licensed healthcare providers, therapists, or clinicians and do not diagnose, treat, monitor, or manage any condition.
No provider-patient, therapist-client, fiduciary, or other professional relationship is created between you and the Company or any peer specialist. You expressly acknowledge that you will not rely on the Services for medical, mental health, or clinical decision-making and that any such decisions are made solely between you and your licensed provider.
You understand and agree that peer support services are inherently limited and may involve discussions of sensitive topics, including mental health, substance use, trauma, housing instability, and personal challenges. By using the Services, you voluntarily assume all risks associated with:

Level Up Spot, LLC does not assume any duty to monitor user activity, communications, or interactions. The Company has no obligation to assess risk, provide crisis intervention, warn third parties, prevent harm, or ensure user safety. The Services are not monitored in real time, and the Company does not guarantee any response to communications or requests.
The Services are not intended for emergency use and do not provide crisis intervention or emergency response services. If you are experiencing a medical or mental health emergency, you must immediately contact 911 or your local emergency services.
In limited circumstances, and only at your request, the Services may provide access to a secure, confidential, and privacy-compliant system designed to facilitate user-directed connections ("warm handoffs") to third-party service providers, including but not limited to therapy, psychiatry, crisis resources, housing, benefits, education, employment, or partner programs. These connections are:
Level Up Spot, LLC does not evaluate, screen, endorse, recommend, supervise, or guarantee any third-party provider, program, or service. The Company does not control the availability, quality, legality, or outcomes of such services. Any relationship formed with a third-party provider is solely between you and that provider. All decisions regarding care, services, or participation are made exclusively by you and your chosen provider. You agree that Level Up Spot, LLC is not responsible or liable for any acts, omissions, errors, or outcomes arising from third-party services.
You may be required to create an account to access certain features. You agree to provide accurate and complete information and to maintain its accuracy. You are responsible for safeguarding your account credentials and for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
Certain features may require identity verification, including through Apple's Verify with Wallet functionality. You consent to the limited sharing of verified attributes as described in our Privacy Policy. We do not collect or store full identification documents. Failure to complete verification may restrict access to certain Services.
Some Services may require payment. All fees are disclosed prior to purchase. Payments are processed through third-party providers. We do not store payment card information. All purchases are final unless otherwise required by law. Pricing may be modified at any time with reasonable notice.

You may submit content through the Services, including messages, identity information, and communications ("User Content"). You retain ownership of your User Content but grant us a limited, non-exclusive license to use, store, and process it as necessary to provide the Services. You acknowledge that all communications through the Services, including those with peer specialists, are informational and non-clinical in nature. The Company does not control, verify, or guarantee the accuracy, completeness, or usefulness of any statements made by peer specialists or users. You agree that Level Up Spot, LLC is not responsible for any advice, statements, or content provided by peer specialists or users, or any emotional, psychological, or other impact of such communications.
The Services may integrate with third-party platforms and providers. We are not responsible for their content, policies, or actions. Your use of such services is at your own risk.
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect your information.
All content and functionality of the Services are owned by or licensed to Level Up Spot, LLC or PeerNextGroup, Inc. You may not copy, modify, distribute, or create derivative works without permission.
The Services are provided on an "as is" and "as available" basis without warranties of any kind. We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability. We do not guarantee that the Services will meet your needs or produce any particular outcome.
To the fullest extent permitted by law, Level Up Spot, LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, without limitation, damages related to:
In all cases, our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Level Up Spot, LLC and its affiliates from any claims, damages, or expenses arising from your use of the Services, your conduct, or your violation of these Terms.
We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may discontinue use at any time.
These Terms are governed by the laws of the State of New York.
Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its consumer rules and governed by the Federal Arbitration Act. Arbitration shall take place in New York, New York. You waive the right to a jury trial and to participate in class or representative actions. You may opt out of arbitration by providing written notice within 30 days of first accepting these Terms.
We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
